Terms of Service

These Terms of Service ("Terms") govern your access to and use of BuildKin's building management platform. By using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using BuildKin, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using BuildKin on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of Services
BuildKin provides a building management platform that enables property managers to track maintenance issues, manage buildings, communicate with residents, and coordinate with technicians. Services may be updated, modified, or discontinued at our discretion.
3. Account Responsibilities
You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Subscription and Payment
- BuildKin offers various subscription plans with different features and limitations.
- Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method.
- Subscriptions are billed yearly and automatically renew unless cancelled.
- Refunds are handled in accordance with applicable EU consumer protection laws.
Plan Changes and Billing
- Upgrades: When upgrading to a higher-tier plan, you will be charged a prorated amount for the difference between plans for the remaining period. Your new plan takes effect immediately.
- Downgrades: You may only downgrade within 15 days before your yearly subscription period ends. The downgrade will take effect at the start of your next billing period.
- Prorated Billing: For upgrades during an active subscription, we calculate the remaining value of your current plan and apply it as credit toward the new plan price.
- After your current period ends, you will be charged the full amount of your new plan for the next billing cycle.
Free Trial Terms
- Free Trial Period: New users may receive a complimentary trial period of up to 20 days to evaluate our services at no cost.
- Trial Access: During the trial period, you have access to all features included in the Starter plan.
- Trial Cancellation: When you subscribe to a paid plan during your trial period, your free trial ends immediately and you will be charged for the selected subscription plan. This action is irreversible - once you upgrade to a paid plan, your trial cannot be reinstated.
- Automatic Conversion: You must manually subscribe to continue using the service after your trial ends. We do not automatically charge you or convert your trial to a paid subscription.
- Trial Expiration: When your trial period expires, access to premium features will be suspended until you subscribe to a paid plan. Your data will be retained for a reasonable period to allow you to subscribe.
5. Acceptable Use
You agree not to:
- Use the service for any illegal purpose
- Upload malicious content or attempt to compromise security
- Send spam or unsolicited communications
- Infringe on intellectual property rights
- Interfere with the proper functioning of the service
6. Intellectual Property
BuildKin and its content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you submit but grant us a license to use it for providing our services.
7. User Content
You are responsible for any content you upload, including issue reports and photos. Content must not violate any laws or third-party rights. We may remove content that violates these Terms.
8. Third-Party Services
Our service integrates with third-party providers including Supabase for data storage and Stripe for payments. Your use of these services is subject to their respective terms and privacy policies.
9. Limitation of Liability
To the maximum extent permitted by law, BuildKin shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Our total liability shall not exceed the amount you paid for the service in the preceding twelve months.
10. Indemnification
You agree to indemnify and hold BuildKin harmless from any claims, damages, or expenses arising from your violation of these Terms or your use of the service.
11. Termination
We may suspend or terminate your access to the service at any time for violation of these Terms or for any other reason. You may cancel your account at any time through your account settings.
12. Governing Law
These Terms are governed by the laws of the Republic of Bulgaria and the European Union. Any disputes shall be resolved in the courts of Sofia, Bulgaria, unless otherwise required by mandatory consumer protection laws.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through the service. Continued use after changes constitutes acceptance of the modified Terms.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
